Throughout this semester, you have been studying the role Human Resources plays in the employer/employee relationship. The success of a business rests squarely on that relationship and how it serves the interests of both the employer and the employee. It is a complicated interaction of needs and wants that can lead to success or failure for both or either party. This writing assignment is based on a negotiation themed case study in which an employer and an employee re-negotiate an employment contract. This employment contract impacts not only the individual employee but also the business, as a whole, and other employees, as well. It brings in many HR topics covered in the class including HR decision-making, corporate budgets, compensation, benefits, performance assessment, employee motivation, performance enhancing strategies and many other topics.
The Fabulous Cosmetics & Lyra Banks Case Study discusses the employer and employee relationship leading up to contract negotiations. The case study also reveals the outcome of the contract negotiations between the parties on the following key issues:
- compensation,
- scheduling,
- probationary period,
- poor performance consequences,
- non compete and contract length
Your paper is a critical thinking and analysis paper, where no additional research beyond the given facts is necessary. Outside research can lead to assumptions that adversely cloud the analysis. For example, this case scenario involves a model that is the face of a cosmetic company. Outside research could lead students to assume that the employee should be treated like a “super model” without considering the size and net worth of the cosmetic company she is negotiating with, leading to an inaccurate conclusion that she is being underpaid. The paper will be a reflection on the outcome of the negotiations from the employer’s perspective covering three sections:
Section I: Employer Concerns – Identify at least 4 areas of concern the employer, Fabulous Inc. needed addressed in the new employment agreement and briefly describe the concern.
Section II: Contract Outcomes – Reflect on how each of the concerns identified in Section 1 were addressed in the final employment agreement between Fabulous Inc and the employee, Lyra Banks. Be sure to indicate which section of the agreement addresses that concern. In addition, discuss how the outcome serves or does not serve the employer’s wants and needs. If a compromise was made, reflect on the reasons why Fabulous made the compromise. Under this section, there should be a separate discussion of each of the 4 areas of concern.
Section III: Overall Assessment of the Agreement – A good contract is one in which the wants and needs of each party are substantially met by the agreements made in the contract. Discuss whether, in your judgment, the employment agreement made between Fabulous, Inc and Lyra Banks is or is not a good one and defend your position (from the employer’s perspective). Do not equivocate – select a position! The contract is either a good one or is not. Give and explain at least 3 reasons for your position. In your explanation, use the facts from the case study and the stated needs of the parties to support your position.
